Defendant convicted of armed robbery

On May 28, 2026, Benoise Wade Jr. was convicted by a jury of robbery and possession of a controlled substance.

The jury also found true aggravating factors that Wade was armed or used a weapon in the commission of the crime and that he threatened witnesses or prevented/dissuaded witnesses from testifying.

On December 15, 2023, Sacramento police officers responded to a robbery. The victim reported that he was in a back bedroom when Wade kicked down the bedroom door while holding a handgun. Wade shot one round on the ground before robbing the victim of cash and his cell phone.

Officers were unable to locate a firearm or shell casings, but found a Glock issued BB gun that appeared to be a real firearm in the bedroom where the robbery occurred.

There was a hole in the wall consistent with what appeared to be a bullet hole. An alibi witness testified at trial that Wade was with her at the time of the robbery. Call records showed she was not with Wade at the time. Wade also tried to persuade the victim to say law enforcement had the wrong person.

Allegations that Wade has prior strike convictions for child molestation and robbery along with additional aggravating factors will be determined at the sentencing hearing.

Wade faces a maximum potential sentence of 31 years to life in prison. Sentencing is set for June 18, 2026, at 1:30 PM in Department 13D before the Honorable Peter Southworth.
