Court sets hearing date for accused’s human rights in aiding of suicide case

In a significant development, a Benin High Court, under the guidance of Justice Igho Patricia Braimoh, has scheduled the hearing for the enforcement of fundamental human rights brought by Chukwudi Akpotowho Mudiaga for April 30, 2024.

Mudiaga finds himself entangled in a legal battle as a defendant in a case involving the aiding of the suicide of Lilian Omokhuale, the daughter of Francis Omoruyi Oloton, a prominent business figure and the CEO of Uyi Technical Company Limited.

The case, filed as suit no B/529M/2023 on November 23, 2023, by Eghosa Aganmwonyi Esq, the leading counsel to the Applicant, requests expedited proceedings and the protection of the applicant.

Barrister Aganmwonyi has also raised concerns about the harassment, unwarranted arrest, cyberbullying, and trial faced by the Applicant, urging the court to intervene.

Justice Braimoh has called for restraint from the respondents, including the Inspector General of Police; Assistant Inspector General of Police, Zone 5; Commissioner of Police, Edo State; Economic and Financial Crimes Commission (EFCC); Department Of State Security Edo Command and Elder Francis Omoruyi Oloton, to avoid jeopardizing the case.

The case was brought before the Benin High Court, Edo State, on Wednesday based on a Motion on Notice pursuant to Order 45 Rule 4 of the Edo State High Court (civil procedures) Rule 2018 and under the inherent jurisdiction of the honorable court.

However, in an interview with journalists at the court, it was revealed that Mr. Omoruyi was only trying to conceal his guilt by harrassing the persons whom his daughter duped.

One of the accused persons who called Omoruyi to complain said upon the receipt of the call that late Lilian was owing him, the father threatened to disown her and reduce her to a mere staff at one of his small-size hotel and deal with her mercilessly. 

He said all these may have been the reason for the daughter to have taken her life, imagining that the only place she could have gotten some support had denied her.

The hearing on April 30 will address the accused’s human rights in the aiding of suicide case comprehensively.
